These Terms and Conditions govern the sale of products through the DWIGER Parts online store and form an integral part of the purchase contract between the seller and the buyer.

Hereinafter referred to as the “Seller” or “DWIGER Parts.”

2. General Provisions

These Terms apply to all orders placed through the DWIGER Parts website, by email, telephone, or through other communication channels of the Seller.

The buyer may be:

  • a natural person purchasing the product outside the scope of business activity;
  • an entrepreneur or legal entity purchasing the product for commercial or professional purposes.

Consumer-protection provisions apply only to buyers acting as consumers.

By placing an order, the buyer confirms that they have read and agree to:

  • these Terms and Conditions;
  • the Payment and Delivery Policy;
  • the Exchange and Return Policy;
  • the Privacy Policy;
  • the Cookie Policy.

3. Product Range

DWIGER Parts offers automotive components, including:

  • carbon-fiber exterior and interior elements;
  • body kits and aerodynamic elements;
  • forged and alloy wheels;
  • exhaust systems;
  • interior parts;
  • accessories and other components for vehicle tuning.

Some products may be manufactured, assembled, or ordered specifically for a particular vehicle.

Product images may show parts after installation, painting, or additional processing. The vehicle and other elements shown in the images are not included unless expressly stated in the description.

4. Product Information

The Seller makes reasonable efforts to provide accurate descriptions, photographs, materials, contents, and compatibility of products.

Minor differences in shade, carbon texture, weave pattern, shape, finish, or appearance may occur due to production characteristics, lighting, and on-screen display.

Where the contents of a set, material, finish, or other characteristics are of material importance, the buyer must clarify them before confirming the order.

Information on the website does not replace an individual technical check of the product's compatibility with a specific vehicle.

5. Vehicle Compatibility

Before placing an order, the buyer must provide accurate vehicle information:

  • make and model;
  • generation and model year;
  • version;
  • body and bumper type;
  • equipment specification;
  • VIN, where required for compatibility verification.

Compatibility may depend on the factory specification, regional version of the vehicle, installed equipment, and previous modifications.

The Seller is not responsible for an incorrect product selection where the buyer:

  • provided incomplete or inaccurate information;
  • refused to provide the VIN;
  • placed the order without compatibility verification;
  • did not disclose previous vehicle modifications.

Normal professional adjustment, fitment of mounting points, or adaptation typical of tuning components does not in itself constitute a product defect or incompatibility.

6. Placing an Order

An order may be placed through the website or agreed with a DWIGER Parts representative.

Submitting a request or adding a product to the cart does not in itself constitute automatic acceptance of the order by the Seller.

Before confirming an order, the Seller may verify:

  • product availability;
  • its price;
  • compatibility;
  • production or delivery lead times;
  • delivery cost;
  • the feasibility of fulfilling the order.

The purchase contract is considered concluded after the Seller has confirmed the order in writing and full payment has been received, unless otherwise agreed in writing.

The Seller may decline an order before its final confirmation, in particular where the product is unavailable, where there is a pricing error, where delivery is not possible, where sanctions or export restrictions apply, or where compatibility cannot be confirmed.

7. Product Price

The product price is stated on the website, in a commercial offer, or in an invoice.

Unless expressly stated otherwise, the product price does not include:

  • delivery;
  • customs duties;
  • import VAT;
  • brokerage fees;
  • installation;
  • painting;
  • preparation and adaptation of parts.

In the case of an obvious technical pricing error, the Seller may correct it before confirming the order and offer the buyer the option to place the order at the correct price.

8. Payment

All orders are placed on the basis of 100% advance payment, unless expressly agreed otherwise in writing.

An order is submitted for production, placed with the supplier, or prepared for dispatch after full payment has been received.

The payment method and payment details are provided upon order confirmation.

Bank charges, payment-system fees, and international transfer costs are paid by the buyer, unless agreed otherwise in advance.

9. Custom-Made and Special-Order Products

Custom-made and special-order products include products that:

  • are manufactured specifically for a particular vehicle;
  • are selected or ordered according to the VIN;
  • have a custom size, offset, color, material, or finish;
  • are painted, modified, or configured according to the buyer's requirements;
  • are not held in stock and are procured specifically to order.

Once such an order is confirmed and paid for, the Seller may immediately begin production, procurement, or preparation of the product.

Once fulfilment has begun, a custom-made order cannot be cancelled or returned, except in cases of a confirmed manufacturing defect or a material non-conformity with the agreed specification.

10. Delivery

DWIGER Parts arranges courier or freight delivery to cities and countries served by the selected carrier.

The delivery cost is calculated individually based on:

  • the destination country and city;
  • the weight and size of the shipment;
  • the number of packages;
  • packaging;
  • the method of transport;
  • insurance and special handling of the shipment.

Estimated delivery times are not guaranteed and may change due to the carrier's operations, customs clearance, weather conditions, transport restrictions, and other circumstances beyond the Seller's control.

Detailed conditions are governed by the separate Payment and Delivery Policy.

11. Customs Charges

International deliveries may be subject to:

  • customs duties;
  • import VAT;
  • brokerage fees;
  • storage and administrative charges;
  • other charges imposed by the destination country.

Unless otherwise stated in the invoice, such costs are not included in the product or delivery price and are paid separately by the buyer.

The buyer is responsible for independently checking local requirements for the import, registration, and use of the ordered product.

12. Receipt of the Product

Upon receipt, the buyer must check:

  • the condition of the packaging;
  • the number of packages;
  • the presence of visible damage.

If damage is found, the buyer should:

  • take photographs or a video;
  • notify the carrier;
  • note the damage in the delivery documents;
  • contact DWIGER Parts without undue delay.

Signing delivery documents without reservation may make it more difficult to submit a claim to the carrier in respect of visible transport damage.

13. Inspection Before Installation

Before installation, painting, or any other modification, the buyer must check:

  • the appearance of the product;
  • the contents;
  • the absence of visible defects;
  • conformity with the order;
  • compatibility with the vehicle.

A product with a suspected defect or non-conformity must not be installed, drilled, cut, sanded, painted, or connected to the vehicle's electronics before this has been agreed with DWIGER Parts.

Starting the installation means that the buyer has carried out a visual inspection and accepted the product, except for hidden defects that could not have been identified during a normal inspection.

14. Installation and Adaptation

The installation of tuning components may require:

  • professional equipment;
  • removal of factory parts;
  • adjustment of mounting points;
  • fitment;
  • painting;
  • connection to the vehicle's electronics;
  • programming;
  • checking of vehicle systems.

The Seller recommends that installation be carried out by qualified professionals.

Professional installation may be arranged at Dwiger Automotive by separate agreement.

The Seller is not responsible for damage resulting from:

  • incorrect installation;
  • unauthorized modification of the product;
  • failure to follow instructions;
  • unqualified fitting;
  • the use of unsuitable fasteners, adhesives, or equipment.

15. Legality of Use and Homologation

Certain tuning components may require separate approval, certification, registration, or amendments to the vehicle's documents.

The buyer is responsible for independently checking the legal requirements of the country in which the product will be installed and used.

The buyer is responsible for the legality of operating the vehicle after the ordered components have been installed.

Unless expressly stated otherwise, the availability of a product in the catalogue does not mean that it is automatically approved for road use in all countries.

16. Consumer's Right of Withdrawal

A buyer acting as a consumer may withdraw from a distance contract within the period established by law, provided the product does not fall within the exceptions provided by law.

The right of withdrawal does not apply to products manufactured or modified in accordance with the buyer's individual requirements.

The conditions, procedure, and exceptions are governed in detail by the separate Exchange and Return Policy.

17. Claims and Defects

The buyer's rights in relation to a defective product are governed by applicable law and these Terms.

When submitting a claim, the buyer must provide:

  • the order number;
  • a description of the problem;
  • photographs and a video of the product;
  • photographs of the packaging and shipping label;
  • vehicle information;
  • information about the installation, if it was carried out.

Damage resulting from incorrect installation, use, accident, external impact, unauthorized modification, or normal wear and tear is not considered a manufacturing defect.

Where a defect could have been identified before installation but the product was installed, painted, or modified, the Seller may take this into account when assessing the buyer's claim.

18. Exchange and Return

Standard products may be returned only in the cases and in the manner provided by law and by the Exchange and Return Policy.

Custom-made, special-order, installed, painted, modified, or buyer-damaged products are not eligible for return or exchange, except in cases provided by law.

The buyer must obtain return instructions before sending the product.

Parcels sent without prior arrangement or as cash-on-delivery will not be accepted.

19. Orders by Entrepreneurs and Legal Entities

A buyer who provides company details, a Company ID, or a VAT ID when ordering, or who uses the product as part of a business activity, is considered an entrepreneur, unless the circumstances indicate otherwise.

The consumer's 14-day right of withdrawal from a distance contract does not apply to such orders.

Return, exchange, or cancellation of a B2B order is possible only by prior written agreement.

20. Ownership and Risk of Damage

Ownership of the product remains with the Seller until full payment is received.

The risk of loss and damage passes in accordance with applicable law and the terms of the selected transport.

For a buyer acting as an entrepreneur, the risk may pass upon handover of the product to the carrier, unless agreed otherwise in writing.

21. Use of Trademarks

The names of manufacturers, vehicle models, and trademarks are used to identify and describe the purpose, compatibility, and style of the product.

Unless expressly stated otherwise, the listing of a product on the website does not imply any official affiliation, approval, or cooperation with the relevant vehicle manufacturer or trademark owner.

22. Intellectual Property

The texts, images, logos, graphics, design, and other materials on the DWIGER Parts website are protected by intellectual-property laws.

Their copying, publication, modification, distribution, or commercial use without the Seller's written consent is prohibited.

23. Limitation of Liability

The Seller is not liable for indirect losses, lost profit, loss of a business opportunity, or vehicle downtime, unless such liability is established by mandatory provisions of law.

The Seller is not liable for delays or failure to perform caused by circumstances beyond its reasonable control, including:

  • delays by the manufacturer or carrier;
  • customs procedures;
  • acts of war;
  • sanctions and export restrictions;
  • strikes;
  • natural disasters;
  • failures of transport, communications, or power supply.

This section does not limit consumer rights that cannot be excluded by contract.

24. Out-of-Court Resolution of Consumer Disputes

In the event of a dispute, the consumer should first contact DWIGER Parts directly in an attempt to resolve the matter.

Where the dispute cannot be resolved, the consumer may apply to the competent authority for the out-of-court resolution of consumer disputes in accordance with the laws of the Czech Republic.

25. Personal Data

Personal data is processed in accordance with the DWIGER Parts Privacy Policy.

Information on the use of cookies is contained in the separate Cookie Policy.

26. Electronic Communication

The buyer agrees that documents, order confirmations, invoices, notifications, and other information may be sent electronically to the email address they have provided.

The buyer is responsible for the accuracy and availability of the contact details provided.

27. Amendments to the Terms

The Seller may amend these Terms and Conditions.

The version of the Terms in effect at the time the contract was concluded applies to a specific order, unless the amendment is required by mandatory legal requirements.

The current version is published on the website together with the date of the latest update.

28. Governing Law

These Terms and Conditions and the purchase contract are governed by the laws of the Czech Republic.

The choice of Czech law does not deprive the consumer of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence, where such provisions apply.

Disputes are heard by the competent courts in accordance with applicable law.

29. Final Provisions

If any individual provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.

Individual written agreements between the Seller and the buyer take precedence over these Terms to the extent that they conflict with them.

  • the Exchange and Return Policy;
  • the Privacy Policy;
  • the Cookie Policy.
